Terms of Service for Sportly

1. Acceptance of Terms

By creating an account as a Club Administrator ("Admin") or by accessing public schedules as a visitor ("Runner"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Sportly platform.

2. The Service

Sportly ("The Service") provides a "Digital Pinboard" technology platform that allows organizations to post workout schedules and status updates.

Technology Provider Only: You acknowledge that Sportly is strictly a software service provider. We do not organize, supervise, staff, or insure any athletic events, running clubs, or workouts listed on the platform. We are not a running club, a coaching service, or a fitness entity.

3. Account Registration and Security

• Admins: To manage a club schedule, you must register for an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials.
• Responsibility: You are fully responsible for all activities that occur under your account. You must notify Sportly immediately of any unauthorized use of your account.

4. Medical Disclaimer & Liability Waiver

No Liability for Events: Sportly is not responsible for the actual running events, routes, selection of terrain, weather decisions, or the safety of participants.

Runners: You participate in any event listed on Sportly entirely at your own risk. You acknowledge that reliance on any information provided on the Service is solely at your own risk.

Admins: You acknowledge that you are solely responsible for your club's insurance, liability waivers, emergency protocols, and member safety. Sportly does not verify the safety or legality of any route or workout posted.

5. User Conduct

Admins agree to use the Service lawfully. You agree NOT to:

• Post content that is unlawful, threatening, abusive, harassing, defamatory, or hateful.
• Post schedules for illegal gatherings or events that trespass on private property.
• Impersonate any person or entity.
• Attempt to disrupt the Service’s servers or networks.

Sportly reserves the right to remove any content or terminate any club account that violates this policy, with or without prior notice.

6. Service Availability and Accuracy

• Uptime: While we strive for reliability, Sportly provides the Service on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee 100% uptime.
• Data Accuracy: The accuracy of the schedule (e.g., "Is the run on?") relies entirely on the Admin's input. Sportly is not liable for missed workouts, wasted travel time, or confusion resulting from server outages, bugs, or an Admin's failure to update the status toggle.

7. Intellectual Property

• Your Content: Admins retain ownership of the text and schedule data they upload. By posting, you grant Sportly a license to display this information publicly on your behalf.
• Our IP: The Sportly code, design, logo, and interactive features (including the status toggle mechanism) are the exclusive property of Sportly.

8. Limitation of Liability

To the fullest extent permitted by law, Sportly and its creators, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury or death resulting from participation in an event found via the Service.
• Loss of profits or data.
• Service interruptions.

9. Indemnification

Admins agree to indemnify, defend, and hold harmless Sportly from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of:

• Your use of the Service.
• Any event or workout you organize or list on the Service.
• Any dispute between you and a Runner/member of your club.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service constitutes acceptance of the modified Terms.
